Forge Athletics – Refund & Return Policy

This Refund & Return Policy (the “Policy”) explains when and how customers of Forge Athletics (“Forge Athletics,” “we,” “our,” or “us”) may receive a refund or return items or services purchased through our gym located at 1984 Tamiami Trail N, Space G0003, Naples, Florida 34102, USA or via the website forgepersonaltraining.com.

By purchasing any program, session, membership or merchandise from Forge Athletics you acknowledge that you have read, understand and agree to this Policy. Where state or national consumer‐protection laws provide additional rights, we will comply with those requirements. All capitalized terms that are not defined in this Policy have the meanings assigned to them in our Terms and Conditions.

1. Program, Membership and Private‑Session Refunds

1.1 No Refunds on Delivered Services

Our personal‑training sessions, boot‑camp classes, mixed‑martial‑arts programs, youth martial‑arts/cross‑training programs and other services are non‑refundable once delivered. We commit significant resources to every client’s program, and your purchase secures a reservation that we cannot re‑sell. Because of this, payments for completed or missed sessions are not refundable.

1.2 Cancellations and Rescheduling

If you are unable to attend a scheduled session, please notify us at least 24 hours in advance so we can attempt to reschedule at no additional cost. “No‑show” appointments and cancellations with less than 24 hours’ notice are forfeited.

1.3 Membership Contracts

Our membership agreements include a cooling‑off period required by Florida’s Health Studio Law. You may cancel your membership by delivering a written notice to us (in person or by mail) before midnight of the third business day after you sign the agreement. Cancellation is without liability, and you are entitled to a full refund of all money paid within ten days of your notice. This right cannot be waived. To exercise your right to cancel, send a signed letter stating your intent to cancel to the address listed below or hand‑deliver it to the front desk.

Outside of this statutory three‑day period, membership and initiation fees are non‑refundable except where required by law or where stated in your membership contract. However, if you cannot use our facilities because you relocate more than 25 miles from Forge Athletics or become medically unable to exercise, please contact us with documentation; we may offer a prorated refund or credit in our discretion.

2. Merchandise Returns and Exchanges

Forge Athletics sells apparel and other fitness merchandise through our studio and (in the future) through our online shop at forgeathletics.com. This section outlines your rights regarding these physical products.

2.1 In‑Studio Purchases

For items purchased in person at our studio:

  • Exchanges Only: We accept exchanges or store credit within 30 days of purchase for apparel and merchandise that are unworn, unwashed and in new condition, with original tags and packaging intact. Bring your item and receipt to our studio during business hours; we will assist you in selecting a replacement item of equal value or issue a store credit.
  • Non‑returnable items: For hygiene and safety reasons we do not accept returns or exchanges on personal‑care items (e.g., water bottles, mouthguards, towels), opened supplements or consumables, custom/special‑order items, or items marked “final sale.”
  • Defects and Damage: If your item is defective or damaged when purchased, please bring it to the studio within seven (7) days with proof of purchase. We will inspect the item and, if the defect is confirmed, offer a replacement or full refund.

2.2 Online Purchases (When Available)

Our forthcoming online store will allow the purchase of apparel and related products. Until that store launches, only in‑studio policies apply. Once online shopping is available, the following terms will apply:

  • Return/Exchange Window: You may return or exchange eligible products within 30 days of delivery. Items must be unused, unwashed and in their original condition with tags and packaging.
  • Process: Contact us by email at info@forgepersonaltraining.com to initiate a return. We will provide you with a Return Merchandise Authorization (RMA) number and instructions for shipping. You are responsible for return shipping costs unless the item is defective or we shipped the wrong product.
  • Refunds: After we receive and inspect your return, we will issue a refund to your original payment method or a store credit. Shipping costs are non‑refundable unless the return is due to our error.
  • Exchanges: To exchange an item, follow the return process above and place a new order for the desired product. Alternatively, we can process an exchange once we receive your return.
  • Exclusions: The non‑returnable categories listed in section 2.1 also apply to online purchases. Gift cards are not redeemable for cash and cannot be returned.

2.3 EU/UK Customers

If you purchase merchandise online from within the European Union, United Kingdom or another jurisdiction that grants a statutory “cooling‑off” period, you may have the right to cancel your purchase within 14 days of receipt and receive a refund. To exercise this right, you must notify us within 14 days and return the item in its original condition. These statutory rights are in addition to, not instead of, our store policies.

3. Gift Certificates and Prepaid Packages

  • Gift Certificates: Gift certificates or gift cards purchased from Forge Athletics are not redeemable for cash, cannot be returned for a refund, and expire as stated on the certificate (where permitted by law).
  • Prepaid Packages: We may offer discounted packages of sessions or classes. Unless otherwise stated in writing, prepaid packages are non‑refundable and expire on the date specified at purchase. If you are unable to use your package due to relocation or a medical condition, please contact us; we may, at our discretion, extend expiration dates or allow you to transfer the package to another person.

4. How to Initiate a Return or Cancellation

To request a refund, exchange or membership cancellation, please contact us using one of the following methods:

5. Processing Refunds and Credits

  • Refund Timeline: If a refund is approved, we will process it within 10 business days. For payments made by credit or debit card, your bank may take additional time to post the credit.
  • Form of Refund: Refunds will be issued to the original payment method or as store credit, depending on your preference and any applicable law. Cash refunds are not provided unless the original payment was made in cash.
  • Partial Refunds: In certain cases (e.g., partial use of a membership), we may offer a prorated refund or credit.

6. Amendments to This Policy

We reserve the right to modify this Policy at any time. The updated version will be indicated by an updated “Effective Date” above. Changes will apply only to purchases made after the date of the revised Policy unless otherwise required by law.
